OVERVIEW OF INTELLECTUAL PROERTY LAW

TRADE MARKS
A trade mark is a mark used or proposed to be used upon or in connection with goods for the purpose of indicating that they are the goods of the proprietor of such trade mark by virtue of manufacture, selection, certification, dealing with or offering for sale. The Trade Marks Act 1906 and Rules thereunder govern the registration, maintenance and proprietary rights related to trade marks in The Bahamas. We still operate under the Old British Classification of Goods and presently do not have legislation in place for the registration of service marks. A trade mark remains in force for fourteen (14) years and can be renewed for like periods.

PATENTS
Patent registration, maintenance and proprietary rights are governed by the Industrial Property Act 1965 and Rules thereunder. The invention must be new and involve and inventive step. The term of a Patent is sixteen (16) years, provided that the first renewal application is filed before the expiration of the 4th year and in respect of 5th year and thereafter on an annual basis.

DESIGN COPYRIGHTS
Design Copyright registration, maintenance and proprietary rights are also governed by the Industrial Property Act 1965 and Rules thereunder. Design copyright is defined under the Act as features of shape, configuration, pattern or ornament of an article or features of pattern or ornament applicable to articles in so far as such features appeal to and are judged solely by the eye. Design Copyrights are renewable for three (3) five-year periods only.
